Terms and Conditions

1. Introduction

These Terms and Conditions form the agreement between Inspired Ed, referred to in this document as the Provider, and the learner, parent, carer, school, local authority, commissioner, education provider or referring organisation purchasing or arranging the service, referred to as the Client.

By purchasing, commissioning or using an Inspired Ed service, the Client confirms that they have read, understood and agreed to these Terms and Conditions.

Inspired Ed provides flexible and personalised distance-learning programmes built around the AQA Unit Award Scheme. Its programmes are intended to support learners who may benefit from alternative, low-pressure, interest-led and accessible approaches to education.

These Terms and Conditions should be read alongside any applicable:

  • Service Level Agreement
  • Invoice or written quotation
  • Individual programme agreement
  • Safeguarding and Child Protection Policy
  • Health and Safety Policy
  • GDPR and Data Protection Policy
  • Complaints Policy

Where an individual written agreement contains terms that differ from this document, the individual written agreement will take priority to the extent of that difference.

2. Programme Options

Inspired Ed offers three principal programme options.

2.1 Option 1: AQA Registration and Assessment

Under this option:

  • The Client delivers or arranges the learner’s education independently
  • The Client selects suitable AQA units, with support from Inspired Ed where agreed
  • Evidence of completed learning is submitted to Inspired Ed
  • Inspired Ed assesses and moderates the evidence against the relevant unit requirements
  • Eligible completed units are submitted for certification
  • Evidence may include written work, photographs, videos, audio recordings, observations, witness statements or other agreed formats

Inspired Ed will only submit a unit for certification where the available evidence demonstrates that the relevant assessment criteria have been met.

2.2 Option 2: Personalised Distance Learning Programme

Under this option:

  • Inspired Ed creates an individual learner profile using information supplied by the Client
  • A personalised digital learning programme is prepared
  • Learning activities are designed around the learner’s interests, abilities, educational needs and preferred ways of working
  • Relevant special educational needs and disabilities and Education, Health and Care Plan targets may be considered
  • Learning is intended to be flexible, manageable and low pressure
  • AQA registration, assessment and accreditation support are included as specified in the purchased package
  • The Client supports the learner to access activities and submit appropriate evidence

The precise number of units, resources and adaptations included will depend on the package purchased.

2.3 Option 3: Activity Box Programme

This option includes the personalised programme described under Option 2, together with one or more physical activity boxes.

Activity boxes may contain:

  • Hands-on learning materials
  • Art and craft resources
  • Sensory-friendly materials
  • Games
  • Practical activities
  • Creative resources
  • Materials connected to personalised AQA units

Boxes will be delivered according to the schedule agreed with the Client.

The precise contents of each box may vary according to the learner’s needs, the programme purchased, safety considerations and material availability.

AQA registration, assessment and accreditation support are included as specified in the purchased package.

3. Inspired Ed’s Responsibilities

Inspired Ed will take reasonable care to:

  • Provide appropriate learning materials for the selected programme
  • Personalise materials using the information supplied by the Client
  • Provide clear guidance about activities and evidence collection
  • Assess submitted evidence against the relevant AQA unit requirements
  • Moderate evidence before requesting certification
  • Request additional or revised evidence where necessary
  • Maintain reasonable communication with the Client
  • Explain relevant expectations, deadlines and service limitations
  • Make reasonable adjustments where appropriate and practicable
  • Store learner information and submitted evidence securely
  • Follow its safeguarding and health and safety procedures
  • Notify the Client of significant delays or changes affecting the programme

Inspired Ed does not guarantee that every planned unit will be completed or certified.

4. Client Responsibilities

The Client is responsible for:

  • Providing accurate, complete and current information about the learner
  • Informing Inspired Ed of relevant educational needs, medical conditions, allergies, sensory sensitivities or safety concerns
  • Informing Inspired Ed of changes that may affect programme delivery
  • Supporting the learner to access the programme at a pace appropriate to their needs
  • Supervising the learner during activities
  • Deciding whether an activity or material is suitable for the learner
  • Following any safety instructions supplied by Inspired Ed
  • Submitting evidence in the agreed format
  • Ensuring submitted evidence is genuine and accurately represents the learner’s work
  • Obtaining any necessary consent before submitting photographs, videos, recordings or personal information
  • Responding within a reasonable period where Inspired Ed requires information or clarification
  • Paying all fees by the applicable due date

The Client must not alter, falsify or misrepresent evidence submitted for AQA assessment.

5. AQA Unit Award Scheme

Inspired Ed provides assessment and certification support through the AQA Unit Award Scheme.

The Unit Award Scheme recognises achievement through individual units with defined outcomes and assessment criteria.

Where a learner successfully completes a unit and provides sufficient evidence, the unit may be submitted for certification.

The Client acknowledges that:

  • Each unit has specific assessment requirements
  • Evidence must demonstrate that all relevant criteria have been met
  • Inspired Ed may request additional, clearer or revised evidence
  • A unit will not be submitted merely because an activity has been attempted
  • AQA may review or audit evidence
  • Evidence may need to be retained for quality-assurance purposes
  • Certification timescales may depend on AQA processing
  • AQA may amend, replace or withdraw units
  • Inspired Ed cannot guarantee certification where AQA requirements are not met

The Client agrees to cooperate with reasonable quality-assurance, moderation or audit requirements.

References to Inspired Ed’s AQA centre status apply only while Inspired Ed remains appropriately registered or approved to provide the relevant service.

6. Evidence Submission

Evidence may be accepted in a range of formats where these are suitable for the relevant unit.

Possible formats include:

  • Written work
  • Photographs
  • Video or audio recordings
  • Completed worksheets
  • Practical work
  • Observational records
  • Witness statements
  • Other agreed evidence

Inspired Ed may reject or request amendments to evidence that is:

  • Incomplete
  • Unclear
  • Illegible
  • Corrupted or inaccessible
  • Unrelated to the unit criteria
  • Insufficient to demonstrate achievement
  • Believed to be inaccurate, misleading or inauthentic
  • Submitted without appropriate consent

The Client should retain original evidence until certification has been confirmed.

7. Fees and Payment

Fees depend on the programme and services selected.

Unless a different price has been confirmed in writing, the standard fees are as follows.

7.1 Option 1: AQA Registration and Assessment

  • £25 annual AQA registration fee
  • £15 per unit assessed

7.2 Option 2: Personalised Distance Learning Programme

  • £25 annual AQA registration fee
  • £25 per unit
  • Discounts may be available for bundled units or themed courses

7.3 Option 3: Activity Box Programme

  • £25 annual AQA registration fee
  • Activity boxes from £75, including one unit
  • Additional units, boxes or resources will be priced separately

7.4 Bespoke Packages

Individual pricing may apply to:

  • Education Other Than at School provision
  • Education Other Than in School provision
  • Education, Health and Care Plan packages
  • Section 19 provision
  • Group programmes
  • Multi-learner programmes
  • Commissioned or specialist provision

The applicable price will be confirmed through an invoice, quotation or written agreement.

8. Invoices and Late Payment

Unless otherwise agreed in writing:

  • Invoices must be paid within 14 calendar days
  • Payment must be made using an accepted payment method
  • The Client is responsible for ensuring that payment details are accurate
  • Programme preparation may not begin until payment has been received
  • Inspired Ed may pause delivery, assessment or certification where payment is overdue
  • Additional work outside the agreed package may be charged separately

Where services are commissioned by a school, local authority or organisation, any separately agreed procurement or payment terms will apply.

9. Digital Content

Digital materials may include personalised resources, worksheets, activity instructions, unit materials, assessments and other downloadable content.

Once digital content has been supplied, downloaded, accessed or prepared specifically for the learner, it will normally be treated as delivered.

The Client must not:

  • Resell Inspired Ed materials
  • Publish them online
  • Distribute them to individuals outside the agreed programme
  • Remove copyright or ownership notices
  • Represent Inspired Ed materials as their own
  • Use a single-learner package for multiple learners without permission

The Client may print and use supplied materials for the learner or learners covered by the agreement.

10. Activity Boxes and Physical Materials

Where an activity box is purchased:

  • The Client must provide an accurate delivery address
  • Boxes will be dispatched according to the agreed schedule
  • Delivery dates are estimates unless expressly guaranteed in writing
  • Equivalent materials may be substituted where an item is unavailable
  • Packaging, brands, colours, quantities and exact contents may vary
  • The Client should inspect the box when it arrives
  • Missing, damaged or unsuitable items should be reported promptly

Activity boxes cannot normally be returned once dispatched, particularly where they contain personalised, perishable, opened or hygiene-sensitive materials.

The Client remains responsible for supervising the use of all physical materials.

11. Cancellations by the Client

The Client may request cancellation by contacting Inspired Ed in writing.

Unless otherwise agreed:

  • Digital programmes are non-refundable once personalised materials have been prepared or issued
  • Assessment fees are non-refundable once assessment work has begun
  • Registration fees are non-refundable once registration has been processed
  • Activity boxes cannot be cancelled once they have been prepared or dispatched
  • No refund will be issued for completed work or services already supplied
  • No refund will normally be issued for partially completed units
  • Non-engagement by the learner does not automatically create a right to a refund

Where a cancellation right applies by law, Inspired Ed will honour that right.

Where the Client asks Inspired Ed to begin providing a service during an applicable cancellation period, the Client may be required to pay for work completed before cancellation.

12. Cancellation by Inspired Ed

Inspired Ed may cancel, suspend or refuse a service where:

  • Required fees remain unpaid
  • Essential information has not been provided
  • The service can no longer safely or reasonably meet the learner’s needs
  • The Client submits fraudulent or misleading evidence
  • The Client uses materials unlawfully
  • The Client behaves abusively, threateningly or discriminatorily
  • A safeguarding concern makes continued provision inappropriate
  • Circumstances outside Inspired Ed’s reasonable control prevent delivery
  • Continuing the service would breach AQA requirements or applicable law

Where Inspired Ed cancels a service for reasons that are not the Client’s fault, any payment for services that have not been supplied will normally be refunded or credited.

Fees for work already completed, resources already prepared, registrations already processed or materials already dispatched may be deducted.

13. Refunds

Any approved refund will normally be made using the original payment method.

Refunds will be considered according to:

  • The type of service purchased
  • The amount of work already completed
  • Whether personalised materials have been prepared
  • Whether physical items have been dispatched
  • Whether AQA registration or assessment activity has begun
  • The reason for cancellation
  • Any applicable legal rights

Inspired Ed may, at its discretion, offer an alternative programme, credit or revised arrangement instead of a refund.

Nothing in these Terms and Conditions limits any statutory right that cannot legally be excluded.

14. Learner Engagement and Progress

Inspired Ed’s programmes are designed to encourage learning through flexible and low-pressure activities.

However, Inspired Ed cannot guarantee:

  • A particular level of engagement
  • Completion of every activity
  • Completion of a particular number of units
  • Certification within a particular period
  • Academic progress of a particular kind
  • Improvement in attendance, behaviour or wellbeing
  • That the programme will remain suitable if the learner’s circumstances change

The Client understands that learner engagement may vary and that progress depends on factors outside Inspired Ed’s control.

Inspired Ed may recommend changes to the programme where engagement is limited, but it is not responsible for forcing or compelling participation.

15. Safeguarding and Welfare

Inspired Ed will follow its Safeguarding and Child Protection Policy.

The Client remains responsible for:

  • The learner’s supervision
  • The safety of the home or learning environment
  • Responding to medical or behavioural emergencies
  • Seeking appropriate clinical, therapeutic or crisis support
  • Informing Inspired Ed of relevant safeguarding information

Inspired Ed does not provide:

  • Therapy
  • Counselling
  • Medical advice
  • Diagnosis
  • Behavioural intervention
  • Crisis intervention
  • Emergency services
  • Continuous supervision

Where Inspired Ed identifies a safeguarding concern, information may be shared with an appropriate authority without the Client’s consent where this is necessary to protect a child or comply with a legal duty.

16. Health and Safety

Inspired Ed will take reasonable steps to select suitable materials and provide appropriate safety instructions.

The Client must:

  • Supervise activities
  • Check materials before use
  • Consider the learner’s age, ability and individual needs
  • Check for allergens or sensitivities
  • Store materials safely
  • Stop any activity that appears unsafe
  • Report injuries, allergic reactions, defects or safety concerns promptly

Inspired Ed is not responsible for injury or loss caused by:

  • Failure to supervise the learner
  • Use of materials contrary to instructions
  • Use of unsuitable household materials
  • Failure to disclose relevant allergies or medical needs
  • Deliberate, reckless or inappropriate misuse

This does not exclude liability where liability cannot lawfully be excluded.

17. Data Protection and Privacy

Inspired Ed will process personal data in accordance with its GDPR and Data Protection Policy and applicable data protection legislation.

Personal data may be used for:

  • Programme administration
  • Personalisation
  • Communication
  • Assessment
  • Moderation
  • Certification
  • Safeguarding
  • Financial and legal compliance

Evidence and learner information may be shared with AQA or another relevant body where necessary for registration, moderation, certification, auditing or quality assurance.

The Client is responsible for ensuring that they have authority to provide personal data to Inspired Ed.

18. Intellectual Property

Unless otherwise stated, all original Inspired Ed learning materials, programme structures, written resources, designs and activity instructions remain the intellectual property of Inspired Ed.

The Client receives a limited, non-exclusive and non-transferable right to use the materials for the learner or learners covered by the purchased programme.

The Client must obtain written permission before reproducing, publishing, adapting, selling or distributing Inspired Ed materials beyond the permitted use.

Work created by the learner remains the learner’s property, subject to any rights required for assessment, moderation and certification.

19. Liability

Inspired Ed will exercise reasonable care and skill when providing its services.

To the fullest extent permitted by law, Inspired Ed will not be responsible for:

  • Indirect or consequential loss
  • Loss of opportunity
  • Loss caused by learner non-engagement
  • Loss or damage to personal property
  • Delays caused by postal or courier services
  • AQA processing delays
  • Supplier shortages
  • Internet, software or technology failures
  • Inaccurate information supplied by the Client
  • Failure by the Client to follow instructions
  • Events outside Inspired Ed’s reasonable control

Inspired Ed does not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Where the Client is acting as a consumer, these Terms and Conditions do not affect the Client’s statutory consumer rights.

20. Events Outside Reasonable Control

Inspired Ed will not be responsible for delay or failure caused by events outside its reasonable control.

These may include:

  • Illness or emergency
  • Severe weather
  • Fire or flooding
  • Postal or courier disruption
  • Supplier failure
  • Internet or technology outages
  • Industrial action
  • Changes to AQA services or requirements
  • Government restrictions
  • Other exceptional circumstances

Inspired Ed will take reasonable steps to communicate significant disruption and resume or adapt the service where possible.

21. Complaints

Concerns should be raised as soon as possible so that Inspired Ed has an opportunity to resolve them.

Complaints will be handled in accordance with the Inspired Ed Complaints Policy.

Making a genuine complaint will not result in unfair treatment of the learner or Client.

22. Changes to Programmes and Terms

Inspired Ed may make reasonable changes to:

  • Learning activities
  • Resources
  • Programme structures
  • Delivery schedules
  • Prices
  • AQA unit availability
  • Policies
  • These Terms and Conditions

Changes may be required because of:

  • AQA updates
  • Changes in law or guidance
  • Safety concerns
  • Supplier availability
  • Changes to service delivery
  • Improvements to resources or procedures

Clients will be notified in advance where a significant change materially affects an existing programme.

Changes to prices will not normally apply retrospectively to services already paid for unless expressly agreed.

23. Ending an Ongoing Programme

Where a programme is supplied on an ongoing basis, either party may normally terminate the agreement by giving 60 days’ written notice, unless a different notice period has been agreed.

During the notice period:

  • Agreed fees remain payable
  • Inspired Ed may continue to issue or prepare resources
  • The Client may continue to submit eligible evidence
  • Outstanding work will be managed according to the agreed programme

Immediate termination may apply in the circumstances described elsewhere in these Terms and Conditions.

24. Third-Party Services

Inspired Ed may rely on third-party services, including:

  • AQA
  • Postal and courier companies
  • Payment processors
  • Email providers
  • Digital storage or communication platforms
  • Suppliers of learning materials

Inspired Ed is not responsible for the independent terms, systems or processing times of third-party providers, although reasonable care will be taken when selecting and using them.

25. No Waiver

If Inspired Ed does not immediately enforce a provision of these Terms and Conditions, this does not mean that the provision has been waived.

Any waiver must be confirmed in writing.

26. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be treated as modified only to the minimum extent necessary to make it lawful and enforceable.

27. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory legal rights available to a consumer in another part of the United Kingdom.

28. Acceptance

By purchasing, commissioning, accessing or continuing to use an Inspired Ed service, the Client confirms that they:

  • Have read these Terms and Conditions
  • Understand the nature and limitations of the service
  • Accept their responsibilities
  • Agree to pay the applicable fees
  • Consent to the programme being delivered on this basis

Where a school, local authority or other organisation commissions the service, the individual accepting these Terms and Conditions confirms that they have authority to do so on behalf of that organisation.
